Limitation of Liability

We will not be liable to you or any other person or entity for any damages whatsoever arising as a result of your use of this website in any way. In addition, where warranties are implied by law, you acknowledge and agree that the total aggregate liability to us is limited to the total amount paid by you for the particular services that are the subject of the cause of action, even if those services were provided to you without cost. This limitation of liability applies to the fullest extent permitted by law, and shall survive any termination or expiration of this agreement or your use of this website or the services found on this website.

Price and payment

The price of any Product is the price in force at the date and time of your order. Although we endeavour to keep prices accurate and up to date, sometimes errors do occur. If a price error has occurred, we will inform you of this as soon as possible.

Any transactions may be subject to sales tax based on the bill-to address or delivery address and the sales tax rate in effect at the time your transaction is completed or at the time of delivery.

You must pay for your Product order by using the payment method available at the time of order. Payment will be taken in full at the time of the order.

Cosa Nostra uses PayPal and Square online as the third party service provider for payment services. By using the Services, you agree to be bound by Paypal/Squares Terms of Service and Privacy Policy. You hereby acknowledge that Cosa Nostra Coffee and these two financial services may share any information and payment instructions you provide to the extent required to complete your transactions in accordance with the Terms & Conditions.

You warrant that all details you provide to us for the purpose of purchasing Products will be correct, that the credit card, debit card or PayPal account which you use is your own and that there are sufficient funds or credit facilities to cover the cost of any Products.

Order and delivery

Cosa Nostra Coffee may, without notice, cancel or otherwise make changes to any orders made via the site, if the products ordered are no longer available or upon your breach of these Terms & Conditions.

Cosa Nostra Coffee will endeavour to process your order and manufacture your Products within 6 business days, however no specific time limit for processing, manufacturing and delivering your order is guaranteed. Cnc will deliver the Products to the delivery address stated by you at the time you make the order. Cnc has the sole right to choose the carrier that will deliver your Products. Products ordered will be sent by regular post unless otherwise stated by Cnc. Your order will be deemed delivered and title and risk of loss transferred to you upon delivery to the address stated in your order. We cannot guarantee that Products ordered will be shipped jointly or be delivered on time by the carrier.

Please check your delivery details are correct at the time of purchase. Cnc will always endeavour to supply you with a tracking number once the item is posted. We are not responsible for nor will we refund items that are delivered to an incorrect address supplied to us.

Returns and refund policy

Once an order is placed we cannot guarantee that any changes are made to it. You do have the option of calling us and if your order is not in production we will do what we can to accomodate you. But unfortunately there’s no guaranteed time frame and if we are unable you are still responsible for payment of your original order. 

If you receive a defect, damaged or incorrect Product (jointly: “defect”), or you are not satisfied with the quality of the Product delivered, you must report it within 7 days after the date you receive the Products by contacting us at [email protected]. You may be asked to provide photographic or other documentary evidence of the existence of the issue for which you make the report.

Subject to CnC’s  “Quality Guarantee”, we will upon your request either redeliver the product or refund the purchase price. If you report the existence of a defect in the product or a dissatisfaction in the quality of the product delivered within the time frame specified above. CnC will not redeliver or refund the purchase price if the defect or dissatisfaction is related to the Customer Content, which you have the sole responsibility for. If we receive repeated requests from you to obtain refunds and have a reasonable basis for concern as to the potential misuse of our refund policy, we reserve the right to not accept additional orders from you and to further investigate the defect or issue before providing additional refunds.

Applicable Law

This agreement is governed by the laws of Queensland, Australia. You consent to the exclusive jurisdiction and venue of the courts of that jurisdiction. Relevant notices may be provided electronically to our contact details set out below. We will also provide notices to you electronically to your last notified email address.

Entire Agreement

These terms of use form the entire understanding between you and us with respect to your use of our website.

Termination/Access Restriction

We reserve the right to terminate your access to this website and the related services or any portion of it at any time, without notice.

Email Marketing

From time-to-time CnC provides useful and engaging information about our products and services by email. By purchasing our products you consent to your email address being added to our client marketing database in accordance with the Australian Communications and Media Authority (ACMA). You identify Cosa Nostra Coffee as the business associated with those emails and have the option to unsubscribe from our database at any time.
